Description | Cookies and other similar technologies can be used to track user behaviour online. So-called third-party cookies then form the basis for sharing data on user behaviour between websites, which poses significant risks to fundamental rights and freedoms. The entire ecosystem of advertising exchanges, demand-side platforms, data exchanges and other online advertising intermediaries is built on this third-party cookie-based data sharing. Although third-party cookies will soon be blocked in all major web browsers, there are techniques to circumvent this blocking and there will be technologies to replace third-party cookies. It is therefore important to continue to regulate the use of cookies and similar technologies, particularly for the purposes of internet advertising. This article describes how the use of cookies and similar technologies is addressed in the current legislation, how these requirements manifest themselves in practice in the field of internet advertising and how the practice of supervisory authorities responds to these manifestations. The aim of the article is then to provide practical recommendations on how to approach the issue of cookies and similar technologies, particularly in relation to advertising on the Internet, on the basis of this background. |
