| Description | The contribution is based on a comprehensive analysis of the expropriation of real estate for mineral extraction in the Czech Republic. It presents the arguments for and against expropriation, emphasising the concept of public interest and its interpretation in case law. It will analyse the current legal framework in detail, including categories of deposits subject to expropriation and procedural specifics, including potential constitutional issues. Particular attention will be paid to the relationship of expropriation to spatial planning and the role of municipalities. Finally, future challenges in this area and the impact of changing geopolitical and environmental factors on mineral extraction, including ensuring energy security in the Czech Republic, will be discussed. |
